1. Acceptance of Terms

Welcome to findcredible. These Terms of Service ("Terms") govern your access to and use of our online application ("findcredible" or "App" or "Site" or "we"), which utilizes Large Language Models ("LLMs" or "AI") and Health-related Information Sources through application programming interfaces ("APIs") and Product Advertising through APIs of third parties to provide information related to health, wellness, and beauty as well as vitamins, supplements, topical products, and other products and services. By accessing or using our App, you agree to be bound by these Terms. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT ACCESS OR USE THE APP.

2. The Site Does Not Provide Medical Advice

THE APP DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. IT IS NOT A SUBSTITUTE FOR A RELATIONSHIP WITH A HEALTHCARE PROFESSIONAL.

If you think you may have a medical emergency, call your doctor or 911 immediately.

The information provided by our App, including any AI-generated responses, linked sources, or product suggestions, is for general informational and educational purposes only. It is not intended to be, and should not be used as, a substitute for professional health or medical advice, diagnosis, treatment, or a substitute for a relationship with your healthcare provider. AI-generated responses may contain inaccuracies, biases, or outdated information and should never replace professional judgment. All health, wellness, and beauty information, including but not limited to information about lifestyle changes, supplements, vitamins, minerals, herbs, topical products, and other formulations, is presented for educational purposes only.

The information and listed supplements, products, and services have not been evaluated by the Food and Drug Administration (FDA) and are not intended to diagnose, treat, cure, or prevent any disease or health condition.

The information provided is for informational and educational purposes only and is not intended as a substitute for advice from your physician or other healthcare professional. The App may provide information about scientific studies and research. Such information is not a guarantee of efficacy or safety for your specific situation. Scientific understanding evolves over time, and studies may have limitations, conflicting results, or may not apply to your specific health conditions.

AI responses have inherent and significant limitations. The AI may "hallucinate" (generate fabricated information that appears factual), produce nonsensical content, provide outdated information, misinterpret research, misattribute information to incorrect sources, or cite non-existent sources. Even when the AI attempts to provide source citations, these citations may be incomplete, inaccurate, or incorrectly attributed due to the technical limitations of AI systems. Source links may lead to content that does not contain the cited information. The AI cannot understand your complete personal context, full medical history, or individual circumstances. You must critically evaluate all information provided, verify all sources independently, and never rely solely on the AI-generated responses when making health decisions.

Any product recommendations provided through the app are based on general information obtained from third-party sources and are not medical recommendations and are not personalized. The App does not consider your specific health history, current medications, allergies, or other individual factors that may affect whether a product is appropriate for you. You MUST consult with a healthcare professional before using any supplement, topical product, or other health-related product.

3. Service Description

findcredible provides general information on health, wellness, and beauty topics through AI-powered responses derived from searches of third-party sources and through product advertising via affiliate links. Our service is designed to provide educational content only and is not a substitute for professional medical advice, diagnosis, or treatment. The App may discuss lifestyle changes, ingredients, dietary supplements, topical products, and other over-the-counter products based on general information gathered from various sources. However, these are not medical advice and should not be interpreted as such.

The App works by processing user queries about health, wellness, or beauty, searching in preset third-party sources selected by the App owner, and using search results to respond to queries. The selection of these sources (designated as "credible" in the App) does not constitute an endorsement or guarantee of the accuracy, completeness, timeliness, or reliability of the information within that source or as presented by the AI. The App attempts to provide sources for information as links, but these sources may be incomplete, inaccurate, or incorrectly attributed due to the nature of AI systems and potential malfunctions. The app may provide incomplete and missing information, and may omit critical and important information. The accuracy, completeness, and reliability of AI-generated responses cannot be guaranteed, and the AI's interpretation or citation of sources may be inaccurate or incomplete. Critical evaluation and independent verification of any information provided by the AI are essential before making any health-related decisions. Reliance on AI-generated content is solely at your own risk.

Any information collected using the search feature is collected from third-party sources in accordance with our good faith interpretation of those sources' terms of service at the time of inclusion in the App. We do not warrant or guarantee that our interpretation is correct or complete, and third-party terms may change without notice to us. We make no representations regarding the accuracy, currency, or lawfulness of any third-party terms. If you believe that our collection of information from a particular source violates that source's terms of service, you may notify us using the contact information in Section 20. Please include specific details of the alleged violation and documentation supporting your claim. We will review claims at our sole discretion and may remove sources we deem inappropriate; however, we are under no obligation to remove any source and may reject claims we determine to be without merit, improperly documented, or not in our business interests to address. Any source removal decision is final and at our exclusive discretion. We reserve the right to restore previously removed sources at any time. You agree that you will not make repeated or harassing claims regarding the same source.

4. User Responsibilities and Eligibility

You agree to:

  • Use the service in compliance with all applicable laws.
  • Maintain the confidentiality of your account.
  • Not share sensitive personal health information that you wish to keep private.
  • Not submit sensitive personal health information (Protected Health Information - PHI) that you wish to keep private, as the App is not designed for secure handling of such information.
  • Acknowledge that any information you enter into the App, including your queries and chat history, may be logged, stored, and processed for the purposes of providing and improving the service, as described in our Privacy Policy in Section 13.
  • Ensure your use of the service does not violate any third-party rights.
  • Understand that AI-generated content may contain inaccuracies, biases, outdated information, or fabrications, and may not always be accurate or applicable to your specific situation. Independently verify any information before relying on it, especially for health decisions.
  • Exercise critical judgment when reviewing any information or suggestions provided by the App.
  • Critically evaluate any information, suggestions, or product recommendations provided by the App.
  • Independently verify any information obtained from the App before relying on it, particularly concerning health decisions.
  • Never use information from the App as a substitute for medical advice, diagnosis, or treatment of any health condition or as a replacement for medical care.
  • Understand that you are solely responsible for any health decisions you make based on information from the App.
  • Be at least 18 years of age or the age of majority in your jurisdiction.
  • Not use the App in a way that could potentially cause harm to yourself or others.
  • Not attempt to reverse engineer the App or use it in any way not intended by its creators.
  • Not use automated means to access or collect data from the App.
  • Assume all risk associated with the use of the App and any information or products obtained through it.

This App is currently intended for users in the United States only. By using the App, you represent and warrant that you are located in the United States.

Commercial Use Restrictions:

  • The following commercial activities are strictly prohibited:
    • Using the App to provide services to third parties.
    • Incorporating App responses or content into commercial products or services.
    • Reselling or redistributing App content or access.
    • Using the App for competitive analysis or to develop competing products.
    • Scraping or systematic collection of App content for commercial purposes.
  • Any business or commercial use:
    • Requires explicit written permission from findcredible.
    • May be subject to separate terms and fees.
    • May result in immediate user or account termination if unauthorized.
    • Legal action for breach of contract and terms of service.
    • Claims for damages and legal fees.

API Usage and Rate Limits

Usage Limitations:

  • We reserve the right to implement and modify usage limits at any time.
  • Limits may include: queries per minute, hour, day, or month.
  • Maximum length of queries.
  • Number of concurrent sessions.
  • Total API calls per user or account.

Rate Limiting:

  • Automated access or scripting is prohibited unless explicitly authorized.
  • We may temporarily or permanently restrict access for exceeding limits.
  • We may implement additional restrictions during high-traffic periods.

Fair Use:

  • Usage must be reasonable and not interfere with other users
  • The following activities are strictly prohibited and constitute a violation of these Terms:
    • Use of any automated systems, including but not limited to robots, spiders, scrapers, crawlers, or any similar data gathering and extraction tools.
    • Use of AI-powered tools, bots, or scripts to interact with the App or make queries.
    • Implementation of automated browser extensions or plugins that interact with the App.
    • Creation or use of automated accounts or multiple user access or accounts for data collection.
    • Any attempt to reverse engineer, decompile, or extract the App's code, algorithms, or data.
    • Systematic downloading, scraping, or harvesting of content, responses, or data.
    • Using VPNs, proxy servers, cookie manipulation, or other tools to circumvent usage limits or hide automated access
  • Violation of these prohibitions may result in:
    • Immediate termination of service without notice.
    • Legal action for breach of contract and terms of service.
    • Claims for damages and legal fees.
    • IP address blocking and permanent user or account suspension.
  • Circumventing rate limits or access restrictions is prohibited and may result in legal action.
  • We actively monitor for violations and employ detection systems to identify prohibited automated access.
  • By using our App, you agree that you will not attempt to circumvent these restrictions or assist others in doing so.

Service Levels:

  • We do not guarantee minimum response times or service levels.
  • We may prioritize traffic based on usage patterns and access levels.
  • We reserve the right to modify or terminate access at any time.

5. Children's Privacy

We are committed to protecting the privacy of children. The App is not intended or designed to attract children under the age of 13. This App is directed to individuals who are at least 18 years old or the age of majority in their jurisdiction. We do not knowingly collect personal information from children under 13 years of age. If you are under 13 years of age, please do not use or provide any information on the App or through any of its features. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information promptly. If you believe we might have any information from or about a child under 13, please contact us immediately at the contact information provided in Section 20.

6. HIPAA Non-Coverage

findcredible IS NOT A "COVERED ENTITY" OR "BUSINESS ASSOCIATE" AS DEFINED UNDER THE HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT OF 1996 ("HIPAA"). The App is not designed to collect, store, or process Protected Health Information (PHI) as defined under HIPAA, and we do not provide services that would make us subject to HIPAA regulations.

You should NOT provide any sensitive personal health information through the App. While your queries about general health topics are processed to provide responses, you should not include specific details about your personal medical history, treatments, diagnoses, or other personal health information that you wish to keep private. Our service is intended to provide general educational information only, not to collect or process your personal health records or data.

By using the App, you acknowledge and agree that your interactions with the App are not confidential medical communications protected under HIPAA or similar regulations, and information you provide may be processed as described in our Privacy Policy in Section 13.

7. Intellectual Property and Use of Content

The content posted on this Site is protected by copyright laws in the United States and in foreign countries. findcredible authorizes you to view or download a single copy of the content solely for your personal, noncommercial use. All rights not expressly granted herein are reserved to findcredible and its licensors.

Any use of the Content not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark, and other laws. If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.

The trademarks, service marks, and logos of findcredible used and displayed on this Site are registered and unregistered trademarks or service marks of findcredible. Nothing on this Site should be construed as granting any license or right to use any findcredible trademarks without our prior written permission. The names of actual companies and products mentioned on the Site may be the trademarks of their respective owners.

AI-Generated Content Ownership and Rights: All content generated by our AI systems through the App ("AI Output"), including but not limited to responses, suggestions, analyses, and recommendations, is the exclusive property of findcredible. By using our App, you acknowledge and agree that:

  • findcredible owns all right, title, and interest in and to all AI Output, including all intellectual property rights therein.
  • While you are granted a limited, non-exclusive, non-transferable license to use the AI Output for your personal, non-commercial use, you may not:
    • Sell, license, sublicense, distribute, or commercially exploit the AI Output.
    • Create derivative works based on the AI Output.
    • Remove any copyright or other proprietary notices from the AI Output.
    • Use the AI Output in any way that violates these Terms.
  • Any modifications, improvements, or derivatives of the AI Output remain the exclusive property of findcredible.
  • The AI Output is protected by copyright and other intellectual property laws, regardless of whether such output is generated in response to your specific queries or inputs.
  • Your use of the AI Output does not grant you any ownership rights or intellectual property rights in the underlying AI models, algorithms, or training data.

8. Third Party Terms and Limitations

Our App uses LLMs which:

  • Are subject to third-party terms of service.
  • May occasionally provide inaccurate, outdated, or incomplete information.
  • May provide information that is incomplete and missing, and may omit critical and important information.
  • Cannot diagnose medical conditions or prescribe treatments.
  • Have inherent limitations in understanding complex medical situations.
  • May present information that appears authoritative but may not be correct.
  • Are not a replacement for consultation with healthcare professionals.
  • May occasionally hallucinate or generate fabricated information, meaning they can create plausible-sounding but factually incorrect or nonsensical content.

Our App also uses Health-related Information Sources which:

  • Are subject to third-party terms of service.
  • May provide inaccurate or outdated information on the benefits of supplements and ingredients.
  • May provide information that is incomplete and missing, and may omit critical and important information about ingredients and any other information provided.
  • May provide health, wellness, and beauty information that is not evaluated by the FDA or another regulatory organization.
  • May present conflicting or contradictory information about the same health topics.
  • May have research limitations or biases not apparent in the summarized content.

Our App also uses Product Advertising which:

  • Are subject to third-party terms of service.
  • May provide inaccurate or outdated product and pricing information, including but not limited to the following information and details: product title, description, pictures, total and unit price, whether the product is made in the USA, whether the product is USP verified or certified, whether the product is EWG verified or certified, whether the product is Non-GMO or GMO free, whether the product is organic or USDA Organic, whether the product is gluten free, whether the product is vegetarian or vegan, and any other product details. It is your responsibility to verify all product details before making a purchase and/or start using the product.
  • May provide information that is incomplete and missing, and may omit critical and important information about products.
  • Lists products that are not intended to diagnose, treat, cure, or prevent any disease.
  • Provides information and statements that are not evaluated by the Food and Drug Administration.
  • Displays products that have varying quality, efficacy, or safety profiles.
  • Does not provide any personalized recommendations based on your specific health needs, nor are they vetted, verified, or guaranteed for safety or efficacy by findcredible.

Affiliate Relationships and Product Recommendations:

  • Financial Relationships: findcredible maintains financial relationships with various third-party products, services, and vendors ("Affiliate Partners"). We may receive compensation when you:
    • Click on affiliate links.
    • Purchase products through our affiliate partnerships.
    • Sign up for services recommended through our App.
  • Compensation Disclosure:

We do not warrant or endorse and shall have no liability or responsibility to you or any other person for any third-party content, information, images, products, or services. findcredible has financial relationships with some of the products and services mentioned on this site, and may be compensated if users choose to click on links and/or purchase products through our affiliate relationships. We use affiliate links and may earn commissions from eligible purchases made through these links. This commission does not affect the price you pay. The commission does not influence our product recommendations. However, you should be aware that product recommendations are influenced by available affiliate partnerships. findcredible does not vet, verify, or guarantee the quality, safety, or effectiveness of any products purchased through our affiliate links. The App may provide links to third-party websites or resources. The App may also use search results that link to third-party websites. findcredible does not recommend and does not endorse the content on any third-party websites. findcredible is not responsible for the content of linked third-party sites, service providers through APIs and otherwise, sites framed within the findcredible Site, third-party sites provided as search results, or third-party advertisements, and does not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites.

10. User Content and Submissions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information about the Site or the App ("Submissions") provided by you to findcredible are non-confidential and shall become the sole property of findcredible. findcredible shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

By using the App, you acknowledge that your queries (which should not contain sensitive personal health information) and the AI-generated responses are collected. This data may be used to provide, maintain, and improve the service, develop new features, conduct analytics and research, train AI models, and monitor for safety and abuse. Your queries and the resulting responses may be shared with and processed by third-party AI service providers (as detailed in our Privacy Policy in Section 13) for the purpose of generating responses and potentially for improving their services, subject to their respective terms and privacy policies. Some queries and responses may be reviewed by human reviewers to improve system performance and safety. We will not sell your personally identifiable information, but anonymized and aggregated data derived from your usage may be used for various purposes as outlined in our Privacy Policy (Section 13). Do not submit any health information that you consider private or sensitive through the App.

By using the App, you explicitly grant findcredible an irrevocable, perpetual, worldwide, royalty-free right to:

  • Store, process, analyze, and use all interactions, queries, and data generated through your use of the App.
  • Use such data to train, improve, and develop AI models and algorithms.
  • Create derivative works based on aggregated usage patterns and data.
  • Share anonymized data with third-party AI providers for service improvement.
  • Retain your data indefinitely for ongoing service improvement and AI training.

You acknowledge and agree that any insights, improvements, or developments derived from your usage data belong exclusively to findcredible, and you have no ownership rights or interest in any such improvements or developments.

Feedback and Suggestions:

  • Ownership and License:
    • All feedback, suggestions, ideas, or other submissions ("Feedback") provided to findcredible become our exclusive property
    • You hereby assign to findcredible all rights, title, and interest (including intellectual property rights) in and to the Feedback
    • This assignment is irrevocable, perpetual, worldwide, and royalty-free
  • Usage Rights:
    • findcredible may use Feedback for any purpose without restriction or compensation
    • This includes but is not limited to:
      • Product development and modification.
      • Marketing and promotional materials.
      • Training AI models.
      • Implementation in current or future products/services.
  • Representations and Warranties:
    • You represent that your Feedback:
      • Is original and you have the right to share it.
      • Does not violate any third-party rights.
      • Does not contain confidential information of any third party.
  • No Obligation:
    • findcredible is under no obligation to:
      • Review or use any Feedback.
      • Maintain any Feedback in confidence.
      • Respond to or acknowledge any Feedback.
      • Compensate you for any Feedback.

11. Limitation of Liability, Disclaimer of Warranties, Indemnification

Your Use of the findcredible Site, App, and Content is Entirely at Your Own Risk.

When using the findcredible Site, information will be transmitted over a medium that may be beyond the control and jurisdiction of findcredible and its suppliers. Accordingly, findcredible assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the findcredible Site.

THE FINDCREDIBLE SITE, APP, AND ALL CONTENT (INCLUDING AI-GENERATED RESPONSES, PRODUCT RECOMMENDATIONS, AND THIRD-PARTY INFORMATION) ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. Findcredible, its affiliates, licensors, and suppliers, to the fullest extent permitted by law, disclaim all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties' rights, accuracy, reliability, completeness, and fitness for a particular purpose. We make no representations or warranties that the app or its content will be error-free, uninterrupted, secure, or free of viruses or other harmful components. We specifically disclaim any warranty regarding the accuracy, reliability, efficacy, safety, or appropriateness of any "ai-generated content", product information, or health-related suggestions provided through the app.

To the maximum extent permitted by applicable law, findcredible, its affiliates, officers, directors, employees, agents, licensors, and suppliers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or any other damages whatsoever (including, without limitation, damages for personal injury, illness, adverse reactions, allergic responses, worsening of health conditions, pain and suffering, emotional distress, wrongful death, loss of profits, loss of data, loss of use, business interruption, property damage, or any other damages or losses) arising out of or in connection with: (a) your access to, use of, or inability to use the App or its Content (including AI-generated responses and product recommendations); (b) your reliance on any information, suggestions, AI responses, or products mentioned or obtained through the App; (c) any conduct or content of any third party on the App, including linked sites or advertisers; (d) any interaction between you and a healthcare provider consulted based on information from the App; (e) any purchase or use of products linked via affiliate relationships; or (f) any unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not findcredible has been advised of the possibility of such damages.

YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF ANY INFORMATION, AI-GENERATED CONTENT, PRODUCTS, OR SERVICES MENTIONED ON OR ACCESSED THROUGH THE APP IS ENTIRELY AT YOUR OWN RISK. We do not guarantee that any supplements, topical products, or other products mentioned on the App will be suitable for you, safe, effective, or produce the desired effects. Product formulations, ingredients, and recommendations change. Some products may cause adverse reactions in certain individuals, and we are not responsible for any such reactions or consequences. It is your responsibility to read product labels carefully and consult with a healthcare professional.

To the extent not prohibited by law, you agree that in no event will findcredible entities (findcredible and its affiliates, officers, directors, employees, agents, licensors, and suppliers) be liable for (a) any damages whatsoever, including any indirect, special, exemplary, incidental, consequential, or punitive damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; business interruption; personal injury; or any other damages or losses) arising out of or relating to the use or inability to use the services, however caused and on any theory of liability, even if the findcredible entities have been advised of the possibility of such damages, whether under these terms or otherwise arising in any way out of or in connection with the services (including any AI-generated output) or these terms, and whether in contract, strict liability or tort (including negligence or otherwise), or (b) for any other claims, demands or damages whatsoever arising out of or in connection with these terms, output, or the delivery, use or performance of the services or output. The findcredible entities' total liability to you for any damages finally awarded under this agreement will not exceed the greater of one hundred dollars ($100.00) or the amount paid by you to findcredible, if any, in the preceding six (6) months for the services (or offerings purchased through the services) giving rise to the claim. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless findcredible and its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers (the "Indemnified Parties") from and against any and all claims, actions, demands, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees and legal costs) arising out of or relating to (a) your access to or use of the App or its Content; (b) your reliance on any information, suggestions, AI-generated content, or product recommendations provided by the App; (c) any purchase or use of products obtained through affiliate links provided by the App; (d) any data or content you submit (excluding Submissions covered under Section 10); (e) your violation of these Terms; (f) your violation of any rights of a third party; or (g) any dispute or issue between you and any third party (including healthcare providers or product vendors). findcredible reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of findcredible. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice and without liability to you. We may from time to time provide enhancements or improvements to the features/functionality of the App, which may include patches, bug fixes, updates, upgrades, and other modifications ("Updates"). Updates may modify or delete certain features and/or functionalities of the App. You agree that we have no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the App to you.

13. Privacy Policy

This Privacy Policy describes how findcredible collects, uses, and shares information about you when you use our App.

Information We Collect: We collect information you provide directly and information collected automatically through your use of the App. This includes:

  • Usage Information: IP address, approximate geographic location derived from IP, browser type and version, device type and characteristics, operating system, referring URLs, session ID, pages visited, links clicked (including source and affiliate links), timestamps of interactions, and other standard log data.
  • Query and Response Data: The questions or prompts you submit to the App related to health, wellness, and beauty, and the AI-generated responses provided. Your queries may contain information about health topics or conditions of interest to you, which may be sensitive in nature. (Reminder: Do not submit sensitive personal health information).
  • Chat History and Session Data: We maintain logs of your interaction sessions, including the sequence and content of your queries and the AI-generated responses.
  • Contact Information: If you contact us directly (e.g., via email), we collect the information you provide, such as your name and email address.
  • Affiliate Interaction Data: Information related to your clicks on affiliate links, which may be shared with affiliate networks for commission tracking purposes.
  • Cookies and Similar Technologies: We use cookies, local storage, and similar technologies to remember your preferences, maintain your session, and collect usage data.

How We Use Your Information: We use the information we collect for purposes including:

  • Providing and Operating the Service: To operate, maintain, and provide the features and functionality of the App.
  • Improving the Service: To understand usage patterns, analyze performance, diagnose technical issues, improve the accuracy and relevance of AI responses, train AI models, and develop new features and services.
  • Security and Abuse Prevention: To monitor for and prevent fraudulent, abusive, or illegal activity.

  • Affiliate Program Management: To track clicks and manage relationships with affiliate partners.

  • Research and Analytics: To conduct research and analytics to better understand how users access and use our App, to improve our services, and to develop new products and features.

Information Sharing: We may share your information in the following circumstances:

  • Service Providers: With third-party vendors and service providers that perform services on our behalf, such as hosting, analytics, AI model providers (who may process queries and responses according to their terms), and search service providers. These providers are typically bound by confidentiality obligations. Your queries and other usage data may be shared with our service providers to process your requests and generate responses. These providers may use this data according to their own privacy policies, which may include using the data to improve their AI models.
  • Search Service Providers: When you submit a query, we use third-party search services to retrieve relevant information. Your query, but generally not your personal identifiers, may be shared with these providers.
  • Affiliate Partners: With affiliate networks when you click on affiliate links, providing them necessary information (which may include your query, non-personally identifiable identifiers, or click data) to track referrals and commissions.
  • Legal Requirements: If required by law, subpoena, or other legal process, or if we have a good faith belief that disclosure is reasonably necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) enforce our Terms of Service or protect the security or integrity of our Service; and/or (c) exercise or protect the rights, property, or personal safety of findcredible, our users, or others.
  • Business Transfers: In connection with a merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company, your information may be transferred as part of that transaction.
  • Aggregated or Anonymized Data: We may share aggregated or anonymized information that does not directly identify you with third parties for research, analytics, or other purposes.

We do not sell your personal information (as typically defined under laws like CCPA). Information shared with AI providers may be subject to their data usage policies for model training, unless otherwise specified by their terms. Data may be processed and stored in the United States or other countries where our service providers operate, which may have different data protection laws than your jurisdiction.

Data Retention: We retain the information we collect for as long as reasonably necessary to fulfill the purposes outlined in this Privacy Policy, provide our services, comply with our legal obligations (e.g., for security, fraud prevention, regulatory requirements), resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purposes for which it is collected and processed. Anonymized or aggregated data may be retained indefinitely.

Cookies and Tracking: We use cookies and similar technologies (like web beacons or local storage) to collect usage information, operate the service, and support affiliate tracking. You can typically manage cookie preferences through your browser settings, but disabling cookies may affect the functionality of the App.

Security: We implement reasonable administrative, technical, and physical security measures designed to protect the information we collect. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee its absolute security.

By using our service, you consent to this transfer of information to the United States or to any other country in which we or our service providers maintain facilities.

To exercise your CCPA rights, please contact us using the information in Section 20. We will respond to verifiable consumer requests within 45 days. We may require additional information to verify your identity before responding to a request.

14. Changes to Terms and Privacy Policy

We reserve the right to modify these terms at any time at our sole discretion. We will notify users of any changes by posting the new Terms of Service on this page. Your continued use of the App following any changes constitutes your acceptance of the modified terms. It is your responsibility to check this page periodically for changes.

15. Governing Law, Mandatory Arbitration, and Dispute Resolution

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the United States and the State findcredible resides in, without regard to its conflict of law principles. The Federal Arbitration Act shall govern the interpretation and enforcement of the arbitration agreement.

The App is intended for use in the United States. If you access the App from outside the United States:

  • You do so at your own risk and are responsible for compliance with local laws.
  • The App is NOT available in and may NOT be used in:
    • Jurisdictions where it may violate local privacy laws (such as GDPR in the European Union).
    • Regions with specific data protection requirements incompatible with our operations.
    • Countries with restrictions on AI technology or health information distribution.
    • Locations requiring local data storage or processing.
    • Areas with specific healthcare information regulations that conflict with our Terms.
  • You may not use the App if:
    • It is prohibited by export control or sanctions laws.
    • Your jurisdiction requires specific licenses or registrations for AI or health information services.
    • Local regulations conflict with our data collection and processing practices.
    • Your location requires specific consumer protection measures we do not provide.
  • We make no representations about:
    • The App's compliance with non-U.S. laws or regulations.
    • The appropriateness or availability of the service for use in other locations.
    • Compatibility with international data protection standards.
    • Adherence to local healthcare information requirements.
  • We actively reserve the right to:
    • Block access from any non-U.S. jurisdiction at our discretion.
    • Terminate user access or accounts accessing the service from restricted territories.
    • Monitor and enforce geographical restrictions.
    • Report violations to relevant authorities.
  • Legal Process:
    • You agree to accept service of process by email to your registered email address.
    • You waive any objections to venue or jurisdiction in the State findcredible resides in.
    • You agree that all disputes will be conducted in English.
    • You accept that U.S. law governs all aspects of your use of the App.

Please read this section carefully – it may significantly affect your legal rights, including your right to file a lawsuit in court and to have a jury hear your claims. It contains procedures for mandatory binding arbitration and a class action waiver.

Informal Dispute Resolution: Before either party may seek arbitration, the party must first send to the other party a written Notice of Dispute ("Notice") describing the nature and basis of the claim or dispute, and the requested relief. The Notice to findcredible should be sent to the contact information provided in Section 20. After the Notice is received, you and findcredible may attempt to resolve the claim or dispute informally. If you and findcredible do not resolve the claim or dispute within sixty (60) days after the Notice is received, either party may begin an arbitration proceeding.

Mandatory Binding Arbitration: You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the App (collectively, "Disputes") that is not resolved informally through the process described above will be resolved solely by binding, individual arbitration and not in a class, representative, or consolidated action or proceeding. You and findcredible agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of these Terms, and that you and findcredible are each waiving the right to a trial by jury or to participate in a class action. This arbitration provision shall survive termination of these Terms.

Conducting Arbitration and Arbitration Rules: The arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (the "AAA Rules") then in effect, except as modified by these Terms. The AAA Rules are available at www.adr.org or by calling 1-800-778-7879. A party who wishes to start arbitration must submit a written Demand for Arbitration to AAA and give notice to the other party as specified in the AAA Rules.

Arbitration Costs: Payment of all filing, administration and arbitrator fees will be governed by the AAA Rules. If you initiate arbitration under the Consumer Arbitration Rules and your claim is deemed frivolous by the arbitrator (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), you will pay the AAA fees required by those rules. Each party shall be responsible for its own attorneys' fees and costs, unless the arbitrator determines that a claim or defense was frivolous or brought for an improper purpose and holds the initiator liable for the other party's fees and costs, or unless otherwise required by applicable law or the AAA Rules.

Class Action Waiver: You and findcredible agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Further, if the parties' dispute is resolved through arbitration, the arbitrator may not consolidate another person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this Mandatory Arbitration section shall be null and void.

Unless you and findcredible otherwise agree, the arbitration will be conducted in the county where we reside. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of documents you and findcredible submit to the arbitrator, unless you request a hearing or the arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.

The following provisions survive the expiration or termination of this Agreement for any reason whatsoever: Section 2 (No Medical Advice), Section 6 (HIPAA Non-Coverage), Section 7 (Intellectual Property), Section 8 (Third Party Limitations), Section 10 (User Content), Section 11 (Limitation of Liability, Disclaimer of Warranties, Indemnification), Section 13 (Privacy Policy), Section 15 (Governing Law, Arbitration, Dispute Resolution), Section 16 (Termination), Section 19 (Complete Agreement).

16. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

17. Force Majeure

findcredible shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond findcredible's reasonable control, including, but not limited to, AI malfunction, mechanical, electronic, or communications failure or degradation, acts of God, terrorism, pandemic, epidemic, or government orders.

18. Severability

If any provision of these Terms is found to be invalid, void, or unenforceable, that provision shall be deemed severable from the remaining provisions and shall not affect the validity and enforceability of any remaining provisions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the intention underlying the invalid provision.

19. Complete Agreement

Except as expressly provided in a particular "legal notice" on the findcredible Site, these Terms and Conditions, including the incorporated Privacy Policy (Section 13), constitute the entire agreement between you and findcredible with respect to the use of the findcredible Site, App, Content, and services, and supersede all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and findcredible with respect to the App. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
